The xxith day of March in the xxviiith year of the Reign our Sovereign Lady Elizabeth of England France and Ireland queen defender of the Faith

I Thomas Luther of Kelvedon in the countie of Essex being sick of body and yet of perfect memory (thanks be to the Almighty god) do make and ordeyn this my last will and Testament in manner and form following, that is to say

First I give and bequeath my Soul into the hands of god the Father and of his Sonne jesus Christ my only Saviour and redeemer and of the Holy Spirit my comforter affeard __ hoping for that glorious kingdom bought and purchased for me by the __ __ ___ of the same lord Jesus Christ

And my body to be buried according to the discretion of my Executors

Concerning the disposition of all my Landes and tenements chattles real and personall and other my goods movable and ___ I will and bequeath them as hereafter followeth that is to say

Firstly I will that Phillipp my well beloved wife shall have and enjoy to have and hold ____ during her naturall life all that my Messuage or tenement lying at Not Hatch within the parish of Stapleford Tawney in the said countie with all and singular the landes thereto belonging ___ in the terms and occupation of my sister Anne Tarrance, wydow together with those landes and pastures commonlie called the Frythes within Stapleford aforesaid which are in my own terms and occupation

Also I will and bequeath to my said wife all that messuage or tenemnet in Stapleford aforesaid with the landes thereto belonging wherein William Lane dwelleth and also those landes and pastures grounds commonly called the Harbord together with one meadow called Maylotte Meadow mow in the terms of my said Sister lying and being in Stapleford aforesaid to have and to hold the aforesaid premises to my said wife and her Assigns for and during her naturall life but yf my said wife shall better lyke to be and remayne in my house at Kelvedon aforesaid then my will is that she shall have a convenient chamber in the Same house during her wydowhood for her and her mayde with ___ ingreess abd egress into and from the same chamber and also thirty pounds lawfull english money yearly to be paid unto her during her lyfe my my Sonne Rychard Luther for and in recompense of those landes as beforehand bequeathed unto her

Item I further wiyll and bequeath to my said wife all such household stuff as she brought at the tyme of my marriage with ther not being otherwise ___ before the tyme of my death

Item ___ further unto my said wife out of my Stocks and ___ which __ have at Kelvedon __ __ __ ___ and two goldrings and twenty pounds in money to be delivered and paid unto her ymmediately after my decease all such Severall bequests

I gyve and bequeath unto my said wife upon this condicion that she shall accept the same in lieu and full satisfaction of her dower ____ she to ___ and take no profit or comodities of this my ___ last wyll and Testaments

Item I gyve and bequeath to Rychard my sonne all thet my moyety or half part of the mannor of Damoyse Hall with all the rights members and appurtenances thereto belonging lying being such in the parrish or parrishes of White Roding and Morrell Roding or of bothe or of eyther of them or all __ such in the countie of Essex and now in the terms and occupation of Robert Dork or of his Assigns

Also I wyll and bequeath unto my said Sonne Rychard all that my now severall messuages or tenements called Malters and ___ with all and singular the lands and profittes and condiitions to them belonging lying in White Roding and Morrel Roding aforesaid or ___ within the counti of Essex now in the terms of Thomas Parrott and Thomas Lynnwood or of their or eyther of their Assigns

Item I gyve and bequeath unto my said sonne Rychard the ___ and ____ of all those my said lands and ___ in Stapleford aforesaid which before by this my last will I have given and bequeathed to my said wife and in case my said wife do refuse the said lands and tenements if given bequeathed unto her in manner aforesaid then I will also the present portion of the same landes and tenements unto my said sonne Rychard and to the yssue male of his body lawfully begotten and for default of such yssue male then to remayne to my Sonne Anthone and to the yssue male of his body lawfully begotten my sonne Anthone or his yssue male paying unto the heyre or yssue female of my said Sonne Rychard the Some of one Thousand pounds

Item my wyll ys further that my said Sonne Rychard shall have and enjoy my moytie of the lease of the mannor and ___ of South Weald which I hold in common with Rychard Luther John Luther Christopher Luther and Thomas Luther my brothers children of __ sett lying and being in the parish of South Weald or __ part in the countie of Essex provided always and my wyll is that yf yt please god my Sonne Rychard do dye without hyres of his body lawfully begotten that then my saide moytie of the lease of the mannor and __ of South Weald aforesaid shall remayne and be to my Sonne Anthonie for and during ___ years as shall then be to come andd unopposed

Item I gyve and bequeath to Anthonie my Sonne all that my manor of Myles alias Myles Hall with all and singular the rightes members and appurtenances thereoto belonging sett lying and being in the parish of Kelvedon aforesaid ___ where within the countie of Essex

Item I gyve unto my said Sonne Anthonie all that my mannor messuage or farms commonlie called by the name of Warden with all the lands and rights members and appurtenances thereto belonging or there withall held or occupied _ lying and being in the parish of Writtle within the lands ___ and now in the terms of Robert Bourne gentleman his Assigns or hyres

Item I give and bequeath further to my said Sonne Anthonie all that my messuage and Tenement in Stapleford Tawney aforesaid wherein Thomas Godfree now dwelleth with all the lands and profyttes and conditions thereto belonging or there with all held or occupied also

I gyve unto my said Sonne Anthonie all that parcell of ____ sett lying in the parish of Barking in the countie of Essex contynuing by ___ my Lease thereabouts with ____ with my said Sonne Anthonie lately purchased of Thomas Paris Esquire and to ___ the said mannors and messuages lands and tenaments and hereditaments with their appurtenances to my Sonne Anthonie and to the yssue male of his body lawfully begotten and for default for such yssue male of his body the remaynder thereof to my saide Sonne Richard and to the yssue male of his bodie lawfully begotten my sad Sonne Rychard or his yssue male payinge out of those heyre or yssue female of my said Sonne Anthonie the Some of one thousand pounds lawfull english money

And for default of such yssue male of the bodie of my said Sonne Rychard and Anthonie lawfully begotten my wyll ys that all my land and tenements shall remaine to the yssue female of the bodie of the said Rychard and Anthonie lawfully begotten and for default of such yssue of the bodies of the said Rychard and Anthonie then to come and remayne to my daughter Margarett and to the yssue of her body lawfully begotten and yf yt shall happen my said daughter Margarett and my Sonnes Rychard and Anthonie do die and depart this world without yssue of any of their bodies lawfully begotten then my wyll ys that all my aforesaid lande and tenements before bequeathed to my sonne Rychard shall remayne to my aforesaid nephews Rychard John Christopher and Thomas Luther my brother John Luthers children and to the yssue male of their bodies lawfully to be begotten and for default of such yssue male of their bodies mawfully to be begotten then to remayne to my right yssue for ever and yf yt fortune my said children Rychard Anthonie and Margarett to die without yssue of their bodies as aforesaid then my wyll ys that these my landes and tenemants and hereditaments which are here before lymited and bequeathed to my Sonne Anthonie shall remayne and be to my well beloved Sonne in Law Wylliam Lowen Doctor of the ___ and to the yssue male of his bodie lawfully begotten and for default of such yssue to remayne to my right yssue forever

Item I wyll and bequeath to my said Sonne Anthonie one bedstead with the ___ feather bed ___ and all othe the furniture to the same as is now standing in the great Chamber at Kelvedon together with two pyllowes two payres of pyllowCases and three payres of sheets to the said bedd and withall the furniture of the same chamber

And my best bedstedd in my Sonne Rychards chambers at Kelvedon with the featherbedd and other furniture two pyllowes and two payres of pyllowCases and three payres of sheets I give and bequeath to my daughter Margarett

Item I gyve and bequeath to the yssue male of the body of my said daughter Margarett now the wife of Robert Wright ___ and ____ of London and for default of such male then to the heyr or yssue female of the body of my said daughter all that my two messuages or tenements with the landes to them belonging or with them now ___ or ___ and now in the severall ___ of Wylliam Fuller and Rychard sett lying and being in the parish of Stapleford Tawney aaforesaid or all where in the countie of Essex provided alwayes and my wyll ys that my Executors and the Survivor of them ______ and ___ and year who retayne and take the yssues and profytte of the said two messuages and tenements with the lands to them belonging as aforesaid ___ such heyr as the oldest yssue male of my said daughter or the severall yssues female of her in case she ave no yssue male shall accomplish the full age of xxi years which said issue and ___ for to be ____ I ___ shall be imployed to the best advantage of my said daughter and of her said yssue and yssues according to the best discretion of my Executirs or the survivor of them and further I wyll that my said Executirs shall within one years next after my decease deliver unto my said Sonne in Law Robert Wright to the full Sum of one hundreth pounds lawfull money he putting in good ___ to my executors or to one of them to ___ to my daughter his wife the lyke sum of one hundreth pounds if she ___ him and in case that he ___ my said daughter then to leave the lyke sum of money to the yssue or yssues of their two bodies begotten

According to the disposition of my goods and Chattles not mentioned in this my last wyll and testament I wyll and bequeath them as there shall be sett down in a ___ to this my present wyll ___ at the tyme of my decease ad also I gyve and bequeath unto the poor and unto my ___ ___ and Servants as shall be contiynued in the same ___ the rest of my goodes and chattles not mentyoned in this my present last wyll and testament nor in The ____ thereunto annexed I give and bequeath to my Sonnes Rychard and Anthonie

Who I make and ordeyne Executors of this my present last wyll and testament and my __ wellbeloved Sonne in Law Wylliam Lowen doctor of the ___ law and my good brother in law Thomas Gooch of Roxwell in the countie of Essex gentleman I ordeyn my overseer thereof ___ unto my sayd Sonne in Law for his payments them to be taken twenty pounds and to my sayd brother for his like payment therein to be take the Sum of Twenty nobles in ___ whereof

I have hereunto set my hand and seal in the presence of the persons whose names are underwrytten

Imprimis

I wyll and bequeath to every parish wherein I have any lands or tenements the some of forty shillings to be distributed to the poor people in ___ of the same parysh within one monthe after my decease.

Item I gyve to Julian Sparrow my mayde ___

Item I gyve to John Yonge my servant ____ and every one of my other servants as well men and women I gyve ___ apiece
