In the Name of God, Amen

the ___ day of ___ in the Eighteenth year of the Reign of our Sovereign Lord Charles by the grace of God of England Scotland and Ireland King Defender of the Faith Anno Dom one Thousand six hundred forty two

I Henry Dawtrey of More in the parish of Petworth in the County of Sussex Knight being of good and perfect memory and indifferent health of body (praysed be Almighty God) do make and ordaine this my last will and Testament in manner and form following

First and principally I bequeath my Soule into the hands of Almighty God from whom I received it trusting assuredly through the merritts Death and Passion of his only Sonne my most merciful Saviour Jesus Christ to obtain full remission of all my Sinnes and eternal life __ the ___ my body to the earth whereof it was made to be buryed amongst my Ancestors in the Chancel adjoining to Parish Church of Petworth aforesaid in such decent manner as to my Executors or such of them as shallbe present at my funeral shallbe thought fit and convenient

And as concerning that worldly estate whereof it hath pleasd god to make me his Steward and Disposer I will devise and bequeath the same as followeth

First I will and devise that Dame Elizabeth my wellbeloved wife shall peacably and quietly have hold and ___ All those my Messuages Landes and Tenements which where heretofore conveyed to or for her in Indenture for terms of her life according to the __ intent and meaning of the same Conveyance

Item I will bequeath and devise to my Sonne William Dawtrey the Somme of one Thousand and two hundred pounds to be payed unto him at his Age of one and Twenty years and to my Daughter Dorothy Dawtrey the Summe of one Thousand pounds to be payd unto her at her Age of one and Twenty years and to my said Sonne William the Sum of forty pounds Annuity and to my sayd Daughter the Summe of Thirty pounds Annuity for their maintenance until each of them shall attain to their sayd several Ages of one and Twenty years the same Annuityes of forty pounds and thirty pounds to bee payd unto them at the Feast of Annunciation of the blessed Virgin Mary and st Michael the Archangel by even portions the first payment to bee made at such of the same feasts as shall happen next after my decease.

Item I will and devise to my Sonne John Dawtrey an Annuity of Twenty Four pounds for his maintenance to be payd unto him at the sayd feats during the lyfe of Mrs Mary Finch widdow the first payment thereof to bee made at such of the sayd feasts as shall come next after my decease

And I do further will and devise that if Henry Dawtrey my Sonne and heir his heirs Executors and Administrators shall not pay the sayd severall annuityes at the times of payment thereof before lymitted and appointed when as often as any of the ___ Annuites or any part of any of them shall mature then such of my sayd Children to whom any such arranged shallbe owing and unpayd or two or all of them no __ shall Require shall or may enter into all or any such my Manors and Messuages lands Tenements and hereditaments in the Counties of Sussex and Essex __ shallnot bee ___ or injoyned at the time of such Entry by any Conveyance ___ or guarantee made by me or any other person or persons __ under whole title __ or hold the same (except my Manner ___ Messuage and demensne lands called More Place) and __ and may from __ __ of ___ have hold and __ the same my Manners and Messuages landes and Tenements into which I have by this my will given them power of entry until __ of the Rents and Profitts thereto they shall be __ and ___ ___ arranged of the sayd Annuities and the Costs and damages which they or any of them shall sustain by reason of the non payment of the sayd Annuities or any part thereof And moreover if my sayd Sonne Henry Dawtrey shallnot pay the said Severall legacies and ___ of one Thousand and two hundred pounds to my sayd Sonne William Dawtrey and the sayd Sume of one thousand pounds to my said Daughter Dorothy at the sayd times before lymitted for payment thereto Then I will and devise unto my said Sonne William and Daughter Dorothy all and every my said Mannors Messuages Lands and Tenements in Pulborough and Petworth and the said Messuages Mary Finch herewith for payment of her gyft as for other form determinable upon her death and the premises called Moore House only exepted

To have to hold two parts of the Same Manner and Premises into three parts to be decided except before excepted to my said Sonne William until the sayd Summe of one Thousand and two hundred pounds on Interest and Consideration for the forfeiture thereof after the Rate of eight pounds per Centum until the payment thereof shallbe duly payed by my Sonne Henry his heirs Executor or Administrators and the other third part of the sayd Manor and Premises except before excepted to my said Daughter Dorothy until the sayd Summe of One Thousand pounds on Interest and Consideration for the forbearance thereof after the Rate of eight pounds per Centum until the payment thereof shallbe duly payd by my sayd Sonne Henry his Executors or Administrators And will and meaning is that there Estate in Common in the sayd Manners and Premises shall continue until each of them bee payed their sayd Legacies of one Thousand and two hundred pounds and one Thousand pounds or Interest and Consideration for the forbearance thereof and not longer And if either of my sayd younger Children William and Dorothy shall happen to dye before his or her sayd Legacy be satisfied and payd then my will and meaning is that the sayd Legacy of him or her so dying shallbe payd by my sayd Sonne Henry unto my two two Younger Chidren which shall Survive to be equally divided between them or to the Survivor of them

And for and concerning the Inheritance and Disposition of the Estate of Inheritance of all and singular my Mannor and Messuags landes Tenemants and hereditaments their appurtenances in the County of Sussex and Essex I will and devise the sum and every part and parcel thereof except the Messuages Landes and tenements conveyed and assured in and for the Jointure of my said wife during the continuance of the same Jointure and not longer and all for except my Messuages Tenements and hereditaments in the Parishes of Petworth and Pulborough aforesaid situate in the sayd County of Sussex whether sayd Mary Finch holdeth or did hold for tenure of her life or other terms determinable upon her death unto my said Sonne and heir Henry Dawtrey

To have to hold for term of his life without Impeachment of __ the Remaynder of ___ thereof as ___ of the Yearly Jointur of Two hundred pounds and not about to such woman as he shall marry and take to wife for term of her lyfe for her Jointure which power to him my sayd Sonne Henry to make such Lease of the Premises or any part thereof and in such manner and form to all means and purposes no Tenant in __ may make by ___ of a Statute or Act of Parliament made in the two and Twentieth Yeare of King Henry the Eighth late King of England

And after his decease and after the decease of such wyfe as __ of my sayd Sonne Henry their severall Estates shall determine

Then the Remaynder thereof to the first Sonne of the body of my sayd Sonne Henry lawfully begotten and of the heirs male of his body lawfully begotten

And for default of such Issue the Remaynder to the second sonne of the body of the sayd Henry lawfully begotten and of the heirs male of his body lawfully begotten

And for default of such Issue the Remaynder to the third sonne of the sayd Henry lawfuly begotten and of the heirs male of his body lawfully begotten

And for default of such Issue the Remaynder to the fourth sonne of the sayd Henry lawfully begotten and of the heirs male of his body lawfully begotten

Same of every the Elder to take before the Younger and of the heirs of the body of every such Sonne lawfully begotten

And for want of such Issue then Remaynder to the said William Dawtrey for term of his life without Impeachment of ___ and with like terms here to his _ for Joynture and before appointed and devised to the wyfe of the said Henry and like power to the sayd William to make Leases of the Premises or any part thereof as before devised to the sayd Henry for Remaynder to the Sonnes of the sayd William in like manner and like stated as before and bequeathed to the Sonnes of the said Henry

And for want of such Issue then the Remaynder to the sayd John Dawtrey for terms of his life without Impeachment of ___ and with like Remaynder to his wife for her Jointure as is before devised to the wife of the sayd Henry Dawtrey and with like power to the sayd John to make Leases of the Premises or any part thereof as before lymitted to the sayd Henry the Remaynder to the Sonnes of the sayd John in like manner and like statsed as before lymitted to the Sonnes of the sayd Henry and for default of such Issue then to the sayd Dorothy snd the heirs of her body

And as for and concerning my said Messuages landes Tenements and hereditaments in Pulborough and Petworth or elsewhere which the sayd Missus Mary Finch holdeth or did hold for terms of her lyfe or other terms aforesayd and which are before excepted I will and devise the same to my sayd sonne John Dawtrey

To have to hold to him and the heirs of his body and for default of such Issue then to the sayd Henry Dawtrey and the heirs his body and for want of such Issue then to the sayd William Dawtrey and to the heirs of his body and for want of such Issue the Remaynder to the sayd Dorothy and the heirs of her body and I do ordaine and appoint that my welbeloved wyfe from the end of the terms of the sayd Missus Finch shall receive and take the ___ and profitts of the Premisses thus Immediately devised to my Sonne John if she keeps her self sole and unmarried until he shall attain to the Age of one and Twenty years for his maintenance

And I do allso will and devise to my sayd loving wyfe the Chamber in my sayd Capital Messuage at More place wherein she usually lodgeth and hath lodged with Closett and Rooms appurtenances used to the sayd ___ Chamber that during her widdowhood only to be convenient ___ and ___ to the same Chamber

And I do allso give and bequeath to my sayd wyfe an array for her sayd Chamber ___ ___ fitt for her degree and calling as the same Chamber is now accomodated __ all ___

Item I give and bequeath unto my sayd lovinge wyfe Dame Elizabeth Dawtrey on silver ___ yw Silver bowles one great Silver salt one ___ ___ one dozen of Silver Spoons

Item I give and bequeath unto my sayd Daughter Dorothy all such Rings Bracelettes and other Jewells whatsoever which are myne or were her Mother’s (my first wyfe) to be delivered unto her by my sayd Executor at her Age of one and Twenty years or sooner or Twenty pounds in money on satisfaction of them at the election of my sayd Daughter

Item I give and bequeath unto my syd Sonne Henry Dawtrey my Chain of ___ and a ___ ring of Gold wherein my Coat of Armes is engraved and my desire is that the same Chains and Rings may continue to the heirs of his house for ensuring Posterity even as the same to me from my Ancestors

Item my desire is that Mister Francis of Whittington shall be presented by my Sonne or other heir to the Parsonage of Waltham (being in my gifte) when it becomes ___ if he not then better provided with. I leave to the discretion of my Sonne or other heir

Item I give and bequeath unto every one of my Servants Twenty shillings

Item I give unto the Poor of the parish of Petworth five pounds to be distributed at the same time as my funeral

Item I give and bequeath unto my loving brother Daniel Dunn Esquire Ten pounds to be bestowed upon some Jewell for his wife in Remembrance of me

Item I give unto John Pay gentleman my first full friend them pounds to be bestowed __ her __ __ in memoriall of me

And I do make them and nominate the sayd Daniell Dunn and John Pay Overseers of this my Will Any my hope is that they will see the same performed and ___ the __ by me ___ in them as so shall ___ them to whose Mercy and Blessings I ___

Item the Residue of all and singular goodes ___ Chattells debts Stock ___ Jewels and hosehold Stuff whatsoever I give and bequeath unto my sayd Sonnes Henry Dawtrey William Dawtrey and my sayd Daughter Dorothy Dawtrey to be equally divided between them ____ with the Consent and approbation of my sayd Overseers provided allwayes that If my sayd Sonne Henry Dawtrey shall well and truly pay or cause to be payd unto my sayd Sonne William Dawtrey ye summe of four hundred pounds of current money and unto my sayd Dorothy Dawtrey the like Somme of four hundred pounds which I do consider to be two thirds of the value of my Personall Estate within the space of one Year next after my decease And if either of sayd Children William and Dorothy shall happen to die in the ___ time Then if my sayd Sonne Henry shall pay or cause to be payd to the Survivor of them the sayd William and Dorothy the Sum of Eight hundred pounds of like lawfull money within the sayd term lymitted for the payment of the sayd several sommes of four hundred pounds That then it shall be lawfull for the sayd Henry Dawtrey to have hold __ and possess all and singular the Residue of my goods ___ Chattels debts Stock ___ jewells and whatsoever not hereby me disposed any thing in this my will contained to the contrary notwithstanding

Lastly I do make and ordain my sayd Sonnes Henry and William Dawtrey Executors of this my last will and Testament

In witness whereof I have hereunto put my had and seal this ___ day of ___ in the eighteenth year of the Reign of our Sovereign Lord King Charles Anno Dom one thousand six hundred forty and Two Sealed and Abscribed in the presence of ___

Codicil to be Inserted

Provided allwayes and my will and further meaning is That whereas my Sonne John Dawtrey is not yet Mentioned for any Dividend or part of money which my desire is showed him That there be two hundred pounds left in banke for his better ___ to be disposed at the best discretion of my two Overseers Daniell Dunn and John Pay and my Executors to be sufficiently assured within one year next after my decease by their best discretion and so god give a blessing to them and me

This was published and acknowledged by Sir Henry Dawtrey to be his last will and testament and by him delivered into my hands this nyneteenth day of July one Thousand six hundred forty and twoo Whereunto I shallbe allways readii to be deposed or attension may Require
